Four former executives of defunct 38 Studios on Friday again asked a R.I. Superior Court judge to dismiss the state's lawsuit against them.
Lawyers for company founder Curt Schilling and executives Rick Wester, Jennifer MacLean and Tom Zaccagnino, said the Rhode Island Economic Development Corporation "failed to present any specific allegations to substantiate any claim that [the] 38 Studios defendants conspired or colluded with anyone to defraud
the EDC."
The state asserts there's "crushing evidence" that Shilling and others concealed financial information about his now-defunct video game company and that its suit against them should be allowed to move ahead.
In November 2012, the state sued Schilling and 13 others hoping to recover some of the millions of dollars loaned to 38 Studios.
