PROVIDENCE -- A federal judge refused to grant an order barring a man who fatally shot a Providence detective at police headquarters in 2005 from serving time in a Rhode Island prison again.
Judge John McConnell Monday denied Esteban Carpio's motion for a restraining order to block the state Department of Corrections from housing him or any corrections staff from coming within 200 feet. McConnell said Carpio's request should first come before a state court judge.
Carpio accused guards of beating him, threatening to kill him and to rape his girlfriend while he was in state prison after his arrest.
Carpio was transferred to prison in Connecticut after being sentenced to life without parole for murdering Detective Sgt. James Allen.
