PROVIDENCE, R.I. -- Defendants being sued by the state in its attempt to recoup money in the aftermath of the 38 Studios loan debacle Friday asked a R.I. Superior Court judge to dismiss the case.
The state's sweeping lawsuit targeted 38 Studios founder Curt Schilling, other company executives and state advisers who crafted the deal that brought the video-game company to Rhode Island, alleging fraud, negligence and legal malpractice.
The state asserted that 38 Studios was destined to fail and that the 14 defendants knew or should have known that the company would become insolvent by 2012.
Schilling and three 38 Studios' executives were among those filing motions to have the case dismissed, as was Keith Stokes, the R.I. Economic Development Corporation's former executive director.
