Proposed urban farm supply store loses in Superior Court; to open, must begin city approval process all over again

PROVIDENCE, R. I. -- A Superior Court judge ruled the owner of CLUCK!, a proposed urban farm-supply store on Broadway, missed a critical step when she sought and ultimately received a zoning variance from the city.

Drake Patten failed to notify, which is required by law, John Paterra and Elizabeth Monaco, who own 414 Broadway. They are within 200 feet of the vacant gas station Patten was renovating on the corner of Courtland Street and Broadway for her store.

Judge Luis M. Matos' Friday decision essentially voids the city's approval, meaning Patten has to start the process over again if she wants to open her business.

In a phone conversation late Friday, Patten said she is "disappointed" and hasn't decided how she will proceed.
