RI Supreme Court orders new trial in drug case where prosecutor accused of improper cross-examination

PROVIDENCE, RI -- The state Supreme Court has ordered a new trial for a man convicted of drug offenses, saying that the prosecutor in the case prejudiced his right to a fair trial by misrepresenting his criminal history and a sentence he received while questioning him during cross-examination.

The high court said that Superior Court Judge Robert D. Krause should have blocked the improper cross-examination and issued an immediate cautionary instruction to the jurors to disregard her questions.

The prosecutor, Maria F. Deaton, no longer works for the attorney general's office.

The defendant, Gerald D. Price, was convicted of possession of marijuana and two counts of possession of cocaine with intent to deliver while armed with or having available a firearm. Krause sentenced him to serve seven years in prison.
